The Biden Administration announced it will ban Chinese airlines from flying into the United States. The decision comes after China refused to comply with U.S. sanctions on North Korea, which the administration says is a violation of international law.

Retaliation by the Biden Administration Against Chinese Airlines

China restricted U.S. airline flights early in the epidemic as part of its pandemic response. This occurred after the United States placed a 14-day restriction on travelers who had visited China during the preceding 14 days. In reaction to China’s restrictions on American airline flights, the Trump administration imposed restrictions on Chinese airline flights. This was obviously protectionist tit-for-tat, not because the United States was imposing any kind of quarantine or testing system on air travel (which it wasn’t).

Chinese restrictions on US airline flights, according to the US, are a breach of the two nations’ air services pact. As a consequence, an international trade crisis erupted when the Chinese authorities informed United Airlines that “five passengers who flew from San Francisco to Shanghai tested positive for COVID-19 on July 21” and that United would face restrictions on its flights as a result.

United Airlines was given three choices by China.

  1. Two San Francisco-Shanghai flights have been canceled.
  2. two flights without passengers are operated
  3. operate four incoming flights with a load factor limit of 40%

United chose the third option, and China stipulated that the load factor limit would apply to four Wednesday flights beginning August 11, 2021.

In response, the US government claims that penalizing airlines for transporting Covid-positive people to China is unfounded (.pdf).

[The United States government] believes that the “circuit breaker” approach puts excessive blame on airlines in the case of passengers who test positive for COVID-19 after arriving in China. Carriers should not be punished if passengers test positive later since they followed all applicable Chinese laws on pre-departure and in-flight procedures. According to those rules, the Chinese government personally clears each and every prospective passenger for travel to China before they leave the United States, after confirming pre-departure testing results and other necessary paperwork. Carriers have no way of independently verifying positive test findings that Chinese authorities claim to have obtained. In addition, there is no means of knowing where or when a tourist acquired COVID-19.

As a result, the US government is restricting Chinese aircraft for reasons unrelated to Covid. The Department of Transportation under the Biden Administration is imposing 40 percent load factor restrictions on four distinct Chinese airlines, across four different routes, and for a period of four weeks.

  • Beijing – Los Angeles with Air China (August 23-29, 2021)
  • Shanghai – JFK, JFK, JFK, JFK, JFK, JFK, JF (August 30-September 5, 2021)
  • Southern China: Guangzhou – Los Angeles (September 6-12, 2021)
  • Xiamen Airlines flies between Xiamen and Los Angeles (September 13-19)

On four flights, United had load factor limits. On four routes, totalling six aircraft, four Chinese carriers have load factor limits. Air China and China Southern only fly once a week, whereas China Eastern and Xiamen Airlines fly twice a week.

China, on the other hand, has the narrative that it is taking Covid-19 seriously, while the US is not. Because the United States objects to China’s health-care policies, it replicates them and then some for reasons other than health. Perhaps Cleavon Little in Blazing Saddles putting a pistol to his own head is a better analogy?

Anyone who anticipated the Biden administration to take a substantially different stance on China than the Trump administration hasn’t been paying attention to the Biden government’s energy or immigration policies.
